IMPORTANT NOTICE: The IndusTrans Industrial Translation Device is currently in active development (pre-release / beta stage). Features, data practices, and capabilities described herein may change as the product evolves. We will notify registered users of material changes to this policy.

 

1. Introduction

IndusTrans Technologies B.V. ("we", "us", or "our") is committed to protecting the personal data of all individuals who interact with our website, our pre-release industrial translation device, and any associated software or services. This Privacy Policy explains how we collect, use, store, and protect your information in accordance with Regulation (EU) 2016/679 (the General Data Protection Regulation, "GDPR") and any applicable national implementing legislation.

This policy applies to our website visitors, registered beta testers, business clients, and any other persons whose data we process in connection with our products and services.

3. What Data We Collect

We may collect and process the following categories of personal data:

 

3.1 — Data You Provide Directly:

     Full name and professional title

     Business email address and telephone number

     Company name, industry sector, and job function

     Login credentials for our beta access portal

     Correspondence, feedback, and support communications

 

3.2 — Data Collected Automatically:

     IP address and approximate geographic location (country/region level)

     Browser type, version, and operating system

     Pages visited, timestamps, and session duration

     Referring URL and exit pages

     Cookie identifiers and similar tracking technologies (see Section 8)

 

3.3 — Device and Usage Data (Beta Participants Only):

     Industrial terminology and language pair combinations submitted for translation

     Device performance metrics and error logs

     Feature usage patterns and interaction data

     Technical configuration settings

 

Note regarding audio and text content: If the translation device processes spoken or typed content during testing, that content may be transmitted to our servers for processing. We minimise retention of such content to what is strictly necessary for quality assurance and model improvement. We do not process Special Categories of personal data intentionally; please do not submit any.

4. Legal Bases for Processing

We process your personal data on the following GDPR legal bases:

     Contract performance (Art. 6(1)(b) GDPR) — to fulfil our obligations under beta testing agreements and service contracts

     Legitimate interests (Art. 6(1)(f) GDPR) — to improve our product, ensure security, and conduct analytics, where these interests are not overridden by your rights

     Legal obligation (Art. 6(1)(c) GDPR) — to comply with applicable EU and Dutch law

     Consent (Art. 6(1)(a) GDPR) — for optional communications (e.g. newsletters) and non-essential cookies, where you have given your explicit consent

5. How We Use Your Data

We use personal data for the following purposes:

     Providing access to and operating the beta translation platform

     Improving translation accuracy and device performance through analysis of usage data

     Communicating product updates, release notes, and beta programme changes

     Responding to support enquiries and technical issues

     Fulfilling legal and regulatory obligations

     Conducting internal research and development on industrial language processing

     Sending marketing communications where you have opted in

 

We do not use your data for automated decision-making that produces legal or similarly significant effects without human review.

6. Data Sharing and Transfers

We do not sell your personal data. We may share data with:

     Cloud infrastructure providers (e.g. hosting, storage) acting as data processors under binding data processing agreements (DPAs)

     Analytics providers operating under strict data minimisation obligations

     Professional advisors (legal, financial) under confidentiality obligations

     Regulatory authorities where required by law

 

International Transfers: Where data is transferred outside the European Economic Area (EEA), we ensure appropriate safeguards are in place, such as the EU Standard Contractual Clauses (SCCs) approved by the European Commission. We are committed to ensuring that all third-country transfers comply with Chapter V of the GDPR.

7. Data Retention

We retain personal data only for as long as necessary for the purposes described in this policy or as required by applicable law. Specifically:

     Beta test participant data: retained for the duration of the beta programme plus 12 months, unless a longer period is required for legal or contractual reasons

     Website analytics data: retained for up to 13 months on a rolling basis

     Support communications: retained for 3 years from the date of resolution

     Financial and contractual records: retained for 7 years in accordance with Dutch accounting law (Burgerlijk Wetboek, Book 2)

 

When retention periods expire, data is securely deleted or anonymised.

8. Cookies and Tracking Technologies

Our website uses cookies and similar technologies. We distinguish between:

     Strictly necessary cookies — essential for the website to function; no consent required

     Analytical/performance cookies — help us understand how visitors use the site; require your consent

     Functional cookies — remember your preferences; require your consent

     Marketing cookies — currently not deployed; we will update this policy if introduced

 

You can manage your cookie preferences through our consent banner or by adjusting your browser settings. Withdrawing consent does not affect the lawfulness of prior processing.

9. Your Rights Under the GDPR

As a data subject under the GDPR, you have the following rights:

     Right of access (Art. 15) — to obtain a copy of your personal data and information about how it is processed

     Right to rectification (Art. 16) — to have inaccurate or incomplete data corrected

     Right to erasure (Art. 17) — to request deletion of your data in certain circumstances

     Right to restriction of processing (Art. 18) — to limit how we use your data

     Right to data portability (Art. 20) — to receive your data in a structured, machine-readable format

     Right to object (Art. 21) — to object to processing based on legitimate interests

     Right to withdraw consent (Art. 7(3)) — at any time, without affecting prior processing

     Right to lodge a complaint (Art. 77) — with your national supervisory authority

 

To exercise any of these rights, please contact us at privacy@industrans.eu. We will respond within 30 days. Dutch residents may lodge complaints with the Autoriteit Persoonsgegevens (autoriteitpersoonsgegevens.nl).

10. Data Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, destruction, or alteration. These include:

     TLS/HTTPS encryption for all data in transit

     Encryption of sensitive data at rest

     Role-based access controls and audit logging

     Regular security assessments and vulnerability management

     Staff training on data protection obligations

 

As the product is in development, we acknowledge that security practices will continue to mature. We will notify affected individuals and the relevant supervisory authority without undue delay in the event of a personal data breach, as required by Art. 33-34 GDPR.

11. Children's Data

Our product and website are designed exclusively for industrial and professional use. We do not knowingly collect personal data from individuals under the age of 18. If we become aware that we have inadvertently collected such data, we will delete it promptly.

12. Changes to This Policy

As our product develops, we may update this Privacy Policy. We will publish the updated policy on this page with a revised effective date. For material changes, we will provide notice via email to registered users at least 14 days in advance of the changes taking effect.

BETA PRODUCT NOTICE: The IndusTrans Industrial Translation Device is a product currently in development and is offered as a pre-release ("beta") solution. Functionality may be incomplete, subject to change, and should not yet be relied upon for safety-critical, life-critical, or legally binding industrial operations without independent human verification.

 

1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between IndusTrans Technologies B.V. ("IndusTrans", "we", "us", or "our") and you, whether as an individual or as a representative of a legal entity ("you" or "Client"), governing your access to and use of the IndusTrans website, the IndusTrans Industrial Translation Device, associated software, firmware, APIs, and any related documentation or services (collectively, the "Services").

By accessing our website, registering for the beta programme, or using the Services in any way, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any supplementary agreements (such as a Beta Participation Agreement or Data Processing Agreement) that may apply.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. These Terms are governed by Dutch law and applicable European Union regulations.

2. Eligibility

You may use the Services only if:

     You are at least 18 years of age

     You are using the Services for professional, commercial, or industrial purposes

     You are not located in, or acting on behalf of an entity in, a jurisdiction subject to EU or Dutch trade sanctions or export restrictions

     You have accepted these Terms and any additional agreements required for your use case

3. Beta Programme Participation

The Services are currently provided as a pre-release beta product. By participating in the beta programme, you acknowledge and agree that:

     The product is under active development and may contain errors, bugs, or incomplete functionality

     Features, specifications, and supported language pairs may change or be removed without notice during the beta phase

     Translation outputs should be reviewed by a qualified human before being used in any operational, regulatory, or safety-relevant context

     We may suspend or terminate beta access at any time at our sole discretion

     Your feedback and usage data may be used to improve the product (subject to our Privacy Policy)

     Beta access does not guarantee access to, or any particular terms for, the commercial product upon its release

4. Licence Grant and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Services solely for your internal professional or industrial evaluation purposes during the beta period.

 

You must not:

     Copy, modify, adapt, translate, reverse engineer, disassemble, or decompile any part of the Services or the device firmware

     Use the Services to develop a competing product or service

     Resell, sublicense, or transfer access to the Services to any third party without our prior written consent

     Use the Services for any unlawful purpose, including in violation of applicable export controls, sanctions, or industrial safety regulations

     Attempt to gain unauthorised access to our systems, networks, or data

     Submit any content that is defamatory, obscene, or infringes third-party intellectual property rights

     Use the Services in safety-critical environments (e.g. nuclear, medical, aerospace) without independent human verification and appropriate regulatory approvals

5. Intellectual Property

All intellectual property rights in and to the Services, including the translation algorithms, software, firmware, user interfaces, trademarks, and documentation, are and shall remain the exclusive property of IndusTrans Technologies B.V. or its licensors. Nothing in these Terms transfers any ownership of intellectual property to you.

 

You retain ownership of any industrial terminology, glossaries, or content you submit for translation. By submitting such content, you grant us a limited, non-exclusive, royalty-free licence to process that content solely as necessary to deliver and improve the Services, subject to our Privacy Policy.

6. Confidentiality

During the beta programme, we may share with you non-public information about the product, roadmap, or technology ("Confidential Information"). You agree to:

     Keep Confidential Information strictly confidential

     Use Confidential Information only for the purpose of evaluating and using the Services

     Not disclose Confidential Information to third parties without our prior written consent

     Notify us promptly if you become aware of any unauthorised disclosure

 

These obligations do not apply to information that is publicly available, independently developed, or required to be disclosed by applicable law or a court order.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" DURING THE BETA PERIOD. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INDUSTRANS MAKES NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF TRANSLATION OUTPUT, OR NON-INFRINGEMENT.

 

In particular, we do not warrant that:

     Translation outputs will be accurate, complete, or suitable for any specific industrial or regulatory purpose

     The Services will be uninterrupted, error-free, or free from security vulnerabilities during the beta phase

     Any defects identified during beta testing will be corrected prior to commercial release

 

Industrial Safety Notice: Translation errors in industrial environments can have serious consequences. You are solely responsible for independently verifying all translation outputs before using them in operational contexts, particularly where equipment safety, regulatory compliance, or personnel welfare are involved.

8. Limitation of Liability

To the maximum extent permitted by applicable Dutch and EU law, IndusTrans Technologies B.V. shall not be liable for:

     Any indirect, incidental, consequential, special, punitive, or exemplary damages

     Loss of profits, revenue, data, business opportunity, or goodwill

     Damages arising from reliance on inaccurate or incomplete translation output

     Downtime or unavailability of the Services during the beta period

 

Our aggregate liability to you under these Terms shall in no event exceed the greater of (i) the total fees paid by you to us in the three months preceding the claim, or (ii) €500 (five hundred Euros), to the extent permitted by law.

 

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by our gross negligence or fraud.

9. Indemnification

You agree to indemnify, defend, and hold harmless IndusTrans Technologies B.V., its officers, employees, and affiliates from and against any claims, damages, losses, and costs (including reasonable legal fees) arising from: (a) your use of the Services in breach of these Terms; (b) your violation of any applicable law or regulation; or (c) any claim that content you submitted infringes a third party's intellectual property rights.

10. Term and Termination

These Terms are effective from the date you first access the Services and continue until terminated.

 

We may terminate or suspend your access:

     Immediately, for breach of these Terms or applicable law

     With 14 days' notice, if we discontinue the beta programme or the Services

     With 30 days' notice, for any other reason at our discretion

 

You may terminate your participation at any time by notifying us at support@industrans.eu and ceasing use of the Services. Sections 5 (Intellectual Property), 6 (Confidentiality), 7 (Disclaimers), 8 (Limitation of Liability), and 11 (Governing Law) survive termination.

11. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. The applicability of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

 

Any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Amsterdam, the Netherlands. Notwithstanding this, nothing prevents either party from seeking urgent injunctive relief before any competent court.

 

If you are a consumer (not applicable if you use the Services in a commercial capacity), EU consumer protection laws may provide you with additional rights that cannot be excluded by contract.

12. Compliance with EU and Industrial Regulations

You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations in your jurisdiction and industry, including but not limited to:

     The EU AI Act (Regulation (EU) 2024/1689), to the extent applicable to your use of AI-powered translation in regulated sectors

     Industry-specific regulations applicable to your sector (e.g. ATEX, Machinery Directive, or sector-specific language requirements)

     Export control regulations, including EU Dual-Use Regulation (EU) 2021/821

     Applicable occupational health and safety laws regarding communication in industrial workplaces

13. Modifications to the Terms

We may update these Terms as the product develops. We will notify you of material changes via email (to the address on file) at least 14 days before the changes take effect. Your continued use of the Services after that date constitutes acceptance of the updated Terms. If you do not accept the changes, you should cease using the Services and notify us of your termination.

14. General Provisions

     Entire Agreement: These Terms, together with the Privacy Policy and any supplemental agreements, constitute the entire agreement between you and IndusTrans regarding the Services.

     Severability: If any provision is found to be unenforceable, the remaining provisions shall continue in full force and effect.

     Waiver: Failure to enforce any provision shall not constitute a waiver of our right to enforce it in the future.

     Assignment: We may assign our rights and obligations under these Terms to an affiliate or successor entity. You may not assign your rights without our prior written consent.

     Language: These Terms are drafted in English. In the event of a conflict between any translated version and the English version, the English version prevails.
